Over the past twenty-five years, thirty-seven states and the US Congress have passed mental health and substance use disorder (MH/SUD) parity laws to secure nondiscriminatory insurance coverage for MH/SUD services in the private health insurance market and through certain public insurance programs. However, in the intervening years, litigation has been brought by numerous parties alleging violations of insurance parity. We examine the critical issues underlying these legal challenges as a framework for understanding the areas in which parity enforcement is lacking, (...) as well as ongoing areas of ambiguity in the interpretation of these laws. We identified all private litigation involving federal and state parity laws and extracted themes from a final sample of thirty-seven lawsuits. The primary substantive topics at issue include the scope of services guaranteed by parity laws, coverage of certain habilitative therapies such as applied behavioral analysis for autism spectrum disorders, credentialing standards for MH/SUD providers, determinations regarding the medical necessity of MH/SUD services, and the application of nonquantitative treatment limitations under the 2008 federal parity law. Ongoing efforts to achieve nondiscriminatory insurance coverage for MH/SUDs should attend to the major issues subject to private legal action as important areas for facilitating and monitoring insurer compliance. Jürgen Habermas has defended Germany’s cautious support for Ukraine against the ongoing Russian invasion. Instead of trying to defeat Russia on the battlefield, he argued that Western nations should seek a compromise with the attacker. Critics worried that this would lead to more suffering than the war, encourage further Russian aggression, and ignore the concerns of the Ukrainian population. However, one question that has not been addressed is if Habermas’s pleas are part of a wider pacifist commitment—and if so, what (...) kind of pacifist he is. Examining Habermas’s writings on the Ukraine War, his cosmopolitan views and his idea of a “constitutionalization of international law,” I argue that Habermas can be called a political pacifist—someone who seeks to abolish the institutions that provide the ultimate causes of war. While one can still criticize his vision, it deserves to be taken seriously as a pacifist account. (shrink)

Abstract:When confronted with moral dilemmas, Charles S. Peirce would recommend that we trust our sentiments, not our reasoning. A scientific exploration of ethics may affect our daily conduct but should only do so gradually. Some modern approaches take the opposite stance and deny the significance of moral sentiments. Considering both Peirce and his opponents, I aim to contribute to the discussion of a radical moral theory: effective altruism. Stating that we should strive to do the most objective good we can, (...) effective altruism regularly conflicts with our moral sentiments. In response, effective altruists claim that our sentiments are misguided and should be overcome. Which side is right? Using Peirce's work to answer this question reveals that effective altruism cannot clearly define how it aims to affect our daily conduct. In addition, it seeks to change our sentiments, but may alter them for the worse. Taking Peirce's insights seriously leads us to conclude that we should be cautious of how we adopt effective altruism in our lives—and that while we deliberate this, we should instead trust our sentiments. In this short paper I propose that the sensorimotor approach to perception is a tree yielding two distinct theoretical fruits. One fruit is sensorimotor reductionism. The other is sensorimotor integrationism. In this paper I try to explain what makes these fruits different.

Exploring history pertinent to evolutionary developmental biology (hereafter, Evo-devo) is an exciting prospect given its current status as a cutting-edge field of research. The first and obvious question concerns where to begin searching for materials and sources. Since this new discipline adopts a moniker that intentionally juxtaposes ‘evolution’ and development’, individuals, disciplines, and institutional contexts relevant to the history of evolutionary studies and investigations of ontogeny prompt themselves. Each of these topics has received attention from historians and thus there is (...) both primary and secondary material from which to draw. For example, many historians have documented the historical trajectories of genetics and embryology, their split, and various relations (or lack thereof), especially in the first three decades of the 20th century. P-hacking or data dredging involves manipulation of the research data in order to obtain a statistically significant result. The reasons behind P-hacking and the consequences of the same are discussed in the present manuscript.

The COVID-19 pandemic has been a data-political spectacle. Data are omnipresent in prediction and surveillance, and even in resistance to governmental measures. How have citizens, whose lives were suddenly governed by pandemic data, understood and reacted to the pandemic as a data-political phenomenon? Based on a study carried out in Denmark, we show how society became divided into those viewing themselves as supporters of the governmental approach to the COVID-19 pandemic, and those who oppose it. These groups seem to subscribe (...) to very different truths. We argue, however, that both sides share a positivist ideal and think that data and facts ought to rule. Both sides have also come to acknowledge that data are not unambiguous, and both cast increasing doubts on political uses of data. Though the people agreeing with, and the people opposing, the government strategy are in many ways surprisingly similar with respect to epistemic norms, they differ in what they perceive as dangerous or desirable, and in who they believe are telling the “truth” about the pandemic. These different perceptions result in different types of pandemic-related activism. Resistance against restrictions is often understood as inspired by conspiracy theories and in some countries anti-restrictions activism has turned violent. In our case, however, we suggest that when looking at similarities and differences across both groups, the gap between those opposing and those agreeing with the government approach is not as unbridgeable as might be suggested by their beliefs in differing truths and the emerging societal division.
